This proceeding involved a motor vehicle accident that occurred on October 21, 2009. The Plaintiff was struck from behind by another vehicle and alleged that he sustained severe post traumatic headaches that were constant and disabling. The Plaintiff had an impressive work history before the accident having worked for the same company for 22 years before the accident and rarely missing any time from work. The Plaintiff alleged that he was unable to return to his job, which he loved, due to the devastating and disabling nature of his headaches and that he was also disabled from all others forms of employment.
The Defendant denied that the Plaintiff’s symptoms were as bad as claimed and alleged that with proper medical treatments the Plaintiff could eventually return to work.
The Plaintiff’s case went to trial on April 22, 2013 and was heard by a Judge and Jury. Judgment was granted on May 13, 2013 and the Jury awarded the Plaintiff $2,203,719 in damages, essentially accepting every claim that was advanced on behalf of the Plaintiff.
